Louisiana Courts Side with Landry & Swarr in Landmark Asbestos Coverage Case

In a major legal victory for asbestos victims across Louisiana, the state’s Fourth Circuit Court of Appeal ruled that long-delayed asbestos related illnesses like mesothelioma can still be covered by insurance even when insurers try to deny those claims as too late. And the Louisiana Supreme Court rejected insurers’ requests to alter the Fourth Circuit’s ruling.

Although insurers argued vehemently that asbestos diseases could never receive insurance coverage under the a policy form known as Worker’s Compensation/Employer’s Liability, the Louisiana Fourth Circuit ruled otherwise. Ruling Summary

Landry & Swarr represented the family of a former stevedore who developed mesothelioma decades after his workplace exposure.

Insurers claimed that because more than 36 months had passed since the policy period ended, coverage was barred.

After two intense hearings, the first before a panel of three judges and the second before a panel of five, the Court disagreed, siding with our team’s argument that the policy language was ambiguous and must be interpreted in favor of coverage.
